These Terms of Service (the “Terms”) are a binding agreement between you and Techfalos, LLC, a Maryland limited liability company (“Techfalos,” “we,” “us,” or “our”), governing your access to and use of the Atavoice website, applications, and related services (collectively, the “Service”). By creating an account, accessing the Service, or clicking a button or checkbox that indicates your agreement, you confirm that you have read, understood, and agree to be bound by these Terms and our Privacy Policy.
If you do not agree to these Terms, do not use the Service.
Atavoice is a practice studio for your voice. The Service lets you listen to short reference renditions of conversational passages, record your own attempt through your browser’s microphone, and receive a numerical readout that describes acoustic properties such as pitch, resonance, prosody, and breathiness, along with an aggregated accuracy and/or perception score.
The Service is an educational and self-coaching tool. It is not a medical device, not a medical treatment, not a therapeutic intervention, and not a clinical service. Nothing in the Service has been prescribed, ordered, recommended, or supervised by a physician, speech-language pathologist, otolaryngologist, voice teacher, or any other licensed professional, and the Service does not establish a doctor-patient, therapist-client, instructor-student, or any other professional relationship between you and Techfalos, LLC or anyone associated with the Service.
The Service is not intended to diagnose, treat, cure, mitigate, or prevent any disease, disorder, condition, symptom, or injury, including but not limited to any voice, throat, vocal-fold, laryngeal, respiratory, neurological, endocrine, psychological, gender-related, or other medical condition. The Service is not a substitute for evaluation, diagnosis, treatment, therapy, training, or advice from a qualified speech-language pathologist, physician, surgeon, voice teacher, mental-health professional, or other licensed professional.
You are solely responsible for deciding whether the Service is appropriate for you, for how long and how often you use it, and for the manner in which you use your voice during and after a session. You agree to consult a qualified professional before using the Service if you have any voice, airway, respiratory, neurological, hormonal, mental-health, or other medical condition that could be affected by voice practice, and to stop using the Service and seek qualified professional care if you experience pain, hoarseness, vocal fatigue, loss of voice, breathing difficulty, emotional distress, or any other adverse symptom. Never disregard, avoid, or delay seeking professional medical or therapeutic advice because of anything you have read, heard, or seen on the Service.
The numerical readouts produced by the Service — including pitch, resonance, prosody, and breathiness metrics, as well as any aggregated accuracy or perception score — are generated by automated signal-processing and modeling techniques that have inherent limitations. Atavoice and Techfalos, LLC make no representation, guarantee, or warranty of any kind, whether express or implied, that any score, metric, band, label, or other assessment generated by the Service is correct, complete, calibrated, clinically valid, or suitable for any particular purpose, including for evaluating how your voice sounds to other listeners.
You acknowledge that scores may be affected by microphone quality, ambient noise, recording technique, network conditions, software version, and other factors outside our control, and that two recordings of the same utterance may produce different scores. Scores are provided for your information and practice only and are used at your own risk. Atavoice and Techfalos, LLC are not responsible for any decision you make, any action you take or refrain from taking, or any emotional, professional, medical, financial, or other consequence you experience, based in whole or in part on a score or other output of the Service.
You must be at least 13 years old to create an account. If you are under the age of majority in your jurisdiction, you may use the Service only with the involvement and consent of a parent or legal guardian who agrees to these Terms on your behalf.
You represent that the information you provide when creating your account is accurate and that you are not barred from using the Service under the laws of the United States or any other applicable jurisdiction.
You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You agree to notify us promptly at contact@techfalos.com if you suspect any unauthorized use of your account. We may suspend or terminate accounts that we reasonably believe have been compromised or are being used in violation of these Terms.

The Service reads your microphone only while you are in an active practice session and only after you explicitly start a recording. By using the Service you confirm that you have the legal right to record the audio you submit and that the audio captures only your own voice.
We do not persist your practice recordings. Audio is processed in memory for the duration of a single analysis request and is then discarded. Only the resulting numerical scores are retained against your account, as described in our Privacy Policy.
The Service, including its software, design, text, graphics, user-interface elements, and catalog reference audio, is owned by Techfalos, LLC or its licensors and is protected by United States and international intellectual-property laws. Subject to your compliance with these Terms, we grant you a personal, limited, non-exclusive, non-transferable, revocable license to access and use the Service for your own non-commercial voice practice.
You retain ownership of the content you submit, including recordings of your own voice. To the extent we process that content to provide the Service, you grant us a limited license to do so as described in the Privacy Policy.
Some features of the Service may be offered free of charge and others may require payment. If a paid feature is introduced, its price and billing terms will be disclosed at the point of purchase. We may add, modify, or discontinue features of the Service at any time, and we may impose reasonable limits on usage to maintain quality of service.
We do not guarantee that the Service will be uninterrupted, error-free, or available at any particular time.
THE SERVICE IS PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS. TO THE FULLEST EXTENT PERMITTED BY LAW, TECHFALOS, LLC DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL MEET YOUR REQUIREMENTS, THAT ANY METRIC, ACCURACY SCORE, PERCEPTION SCORE, OR OTHER NUMERICAL OR DESCRIPTIVE OUTPUT IT PRODUCES IS CORRECT, ACCURATE, CALIBRATED, OR APPROPRIATE FOR ANY PARTICULAR PURPOSE, OR THAT YOUR USE OF THE SERVICE WILL PRODUCE ANY PARTICULAR OUTCOME. ALL USE OF, AND RELIANCE ON, SUCH SCORES AND OUTPUTS IS AT YOUR SOLE RISK.
You acknowledge that voice practice of any kind — including listening to references, attempting to match pitch or resonance, repeated phonation, sustained speech, and the other activities that the Service supports — carries inherent risks, including but not limited to vocal fatigue, hoarseness, throat irritation, vocal-fold strain or injury, breathing changes, anxiety or emotional discomfort about how your voice sounds or scores, and dissatisfaction with results. You voluntarily assume all such risks when you choose to use the Service.
Because the Service is not a medical device, not a medical treatment, and not prescribed, ordered, supervised, or endorsed by any physician, speech-language pathologist, voice therapist, or other licensed professional, you agree that Techfalos, LLC and its officers, members, employees, contractors, agents, and licensors (collectively, the “Released Parties”) do not provide medical, therapeutic, clinical, diagnostic, or professional advice of any kind through the Service, and that no doctor-patient, therapist-client, or other professional relationship is created by your use of the Service.
To the fullest extent permitted by law, you waive, release, and forever discharge the Released Parties from any and all claims, demands, causes of action, suits, damages, losses, liabilities, costs, and expenses of any kind — including for physical injury, vocal injury, aggravation of any pre-existing condition, breathing or airway issues, emotional or psychological distress, gender dysphoria or gender-related distress, delay in seeking or receiving professional care, or any other harm — that arise out of or relate in any way to your use of the Service, your reliance on any score, metric, label, band, or other output of the Service, or any decision you make or refrain from making based on the Service. You agree that the Released Parties have made no representation, promise, warranty, or guarantee, express or implied, that the Service will produce any particular outcome, alter how your voice sounds to other listeners, or be safe or effective for you in any respect, and that you are not relying on any such representation.
If you do not agree to assume these risks and release the Released Parties on these terms, do not use the Service.
TO THE FULLEST EXTENT PERMITTED BY LAW, TECHFALOS, LLC AND ITS OFFICERS, MEMBERS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF DATA, REVENUE, OR GOODWILL, ARISING OUT OF OR RELATING TO YOUR USE OF THE SERVICE, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. WITHOUT LIMITING THE FOREGOING, TECHFALOS, LLC WILL NOT BE LIABLE FOR ANY PHYSICAL INJURY, VOCAL INJURY OR STRAIN, AGGRAVATION OF ANY PRE-EXISTING MEDICAL CONDITION, BREATHING OR AIRWAY ISSUES, EMOTIONAL OR PSYCHOLOGICAL DISTRESS, OR DELAY IN SEEKING OR RECEIVING PROFESSIONAL CARE, ALLEGED TO HAVE BEEN CAUSED IN WHOLE OR IN PART BY YOUR USE OF, OR INABILITY TO USE, THE SERVICE. OUR AGGREGATE LIABILITY FOR ALL CLAIMS RELATING TO THE SERVICE WILL NOT EXCEED THE GREATER OF (A) THE AMOUNTS YOU PAID US FOR THE SERVICE IN THE TWELVE MONTHS PRECEDING THE EVENT GIVING RISE TO LIABILITY OR (B) ONE HUNDRED U.S. DOLLARS ($100).
You agree to indemnify and hold harmless Techfalos, LLC and its officers, members, employees, and agents from any claims, damages, liabilities, costs, and expenses (including reasonable attorneys’ fees) arising out of or relating to your use of the Service, your content, or your violation of these Terms.
You may stop using the Service and close your account at any time. We may suspend or terminate your access to the Service at our discretion, including for violation of these Terms. Sections that by their nature should survive termination — including ownership, disclaimers, limitations of liability, and dispute resolution — will survive.
These Terms are governed by the laws of the State of Maryland, United States, without regard to its conflict-of-laws principles. The exclusive venue for any dispute arising out of or relating to these Terms or the Service is the state or federal courts located in Anne Arundel County, Maryland, and you consent to the personal jurisdiction of those courts.
We may update these Terms from time to time. If we make a material change, we will post the updated Terms on this page and update the effective date above. Your continued use of the Service after an update means you accept the revised Terms.
